Welcome to ClubQ. These Terms of Use ("Terms") govern your access to and use of the ClubQ website, dashboard, mobile applications, content, products, and services (together, the "Services"). Please read these Terms carefully. By accessing or using the Services, you agree to be bound by them.
1. Contractual Relationship
These Terms operate as a binding agreement between you (and, where applicable, the business you represent) and ClubQ regarding your use of the Services. If you are using the Services on behalf of a company or other organisation, you represent that you have authority to bind that entity to these Terms. If you do not agree to these Terms, you may not access or use the Services.
2. The Services
ClubQ provides an AI-first operating system for food & beverage businesses, including — but not limited to — point of sale, digital menus, scan & pay, loyalty programs, customer relationship management, campaigns, and analytics. We may add, modify, or remove features from time to time to improve the Services.
The Services are provided to help you operate your business; you are responsible for how you use them and for the data you and your customers submit through the Platform.
3. User Obligations
By using ClubQ, you represent, warrant, and agree that:
- You have the legal authority to enter into this agreement.
- You will use the Services for lawful purposes only and in compliance with all applicable laws and regulations.
- You will keep your account credentials secure and are responsible for all activity under your account.
- You will not misuse the Services, attempt to gain unauthorised access, disrupt the Platform, or infringe the rights of others.
- You have obtained any necessary consents from your customers for data you collect and process through ClubQ, and will handle that data in accordance with applicable law.
4. Subscriptions & Payment
Access to certain Services requires a paid subscription. By subscribing, you agree to pay the applicable fees for your selected plan. Fees are billed in advance on a recurring basis (monthly or as otherwise stated) and, unless stated otherwise, are exclusive of taxes.
Payments are processed by our third-party payment provider. Subscriptions renew automatically unless cancelled before the renewal date. Except where required by law, fees already paid are non-refundable. We may change our fees on reasonable notice.
5. Customer Data & Intellectual Property
You retain ownership of the data you and your customers submit through the Services ("Customer Data"). You grant ClubQ a limited licence to host, process, and use Customer Data solely to provide and improve the Services and as described in our Privacy Policy. ClubQ retains all rights to the Platform, software, and underlying technology.
6. Disclaimers and Limitation of Liability
The Services are provided "as is" and "as available." To the fullest extent permitted by law, ClubQ disclaims all representations and warranties, express, implied, or statutory, not expressly set out in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.
To the fullest extent permitted by law, ClubQ shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, or business interruption, arising out of or related to your use of the Services.
7. Governing Law
These Terms are governed by and construed in accordance with the laws of the United Arab Emirates, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of the UAE.
8. Changes to Terms
ClubQ reserves the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page and updating the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
